Chaosium argues that Mongoose did not have sufficient rights to grant the rights conveyed by the OGL. However, they muddy the waters by arguing that Mongoose DID possess the necessary rights at one point, but these rights were terminated when they lost the RQ license. This probably indicates a misunderstanding, since if the material was legally released as Open Game Content in the first place, that status can't be revoked. That's what section 2 means when it says that it is a perpetual, worldwide, royalty-free, non-exclusive license. The real question is whether Greg Stafford ever granted permission for Mongoose to release the SRD. And we may never know the answer to this. Issaries did not defend their trademark at the time. <br /><br />Section 6 of the OGL does require the user to update the copyright notice to indicate the source of the upstream material used. It requires you to include the "exact text of the COPYRIGHT NOTICE of any Open Game Content You are copying, modifying or distributing". Accordingly, references to the names of products in Section 15 do not constitute any claim of compatibility. Indeed, you can adapt OGC from one game system for use with a different game system entirely but you must still list the upstream sources in Section 15. And although Runequest is a registered trademark, you can still mention it here under the doctrine of nominative fair use (since this is a statement of fact identifying a product or service without suggesting sponsorship or endorsement by the trademark holder). I would argue that the 1981 ruling of Playboy Enterprises, Inc. v. Welles might be relevant since the right to use the term Runequest in Section 15 was granted by the legitimate trademark holder and thus there is no risk of trademark dilution. The fact that the licence is perpetual means that this permission - once granted - cannot be withdrawn. <br /><br />Having said this, the MRQ I SRD is indeed an ungodly mess and a legal minefield.
